These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User") and Urban Scartify ("Company", "we", "us"), operated on the Nexorai Cart platform. By registering an account, making a purchase, or using any feature of the Urban Scartify website, you confirm that you have read, understood, and agreed to these Terms.

2. Eligibility

To use the Urban Scartify (Nexorai Cart) platform, you must:

• Be at least 18 years of age, or have the consent of a parent/legal guardian
• Provide accurate, complete, and current account information
• Not use the platform for any illegal or unauthorised purposes
• Comply with all applicable Indian laws and regulations

3. Account Registration

You may be required to create an account to access certain Nexorai Cart features. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your Urban Scartify account
• Notifying us immediately of any unauthorised account access

Urban Scartify reserves the right to terminate accounts that violate these Terms or engage in fraudulent behaviour.

4. Products and Pricing

Urban Scartify (Nexorai Cart) strives to display accurate product information, descriptions, and pricing. However:

• Product images are for illustration purposes and may vary slightly from actual products
• Prices are subject to change without notice
• We reserve the right to cancel orders placed at incorrect prices due to typographical errors
• All prices are inclusive of applicable GST unless otherwise stated

5. Orders and Payment

When you place an order on Urban Scartify:

• You make an offer to purchase the listed product(s) at the stated price
• We accept your order by sending an order confirmation email
• Payment must be completed at the time of checkout via approved methods
• Urban Scartify uses Nexorai Cart's secured payment gateway — we do not store payment card data
• Orders may be cancelled at our discretion if payment cannot be verified or items are out of stock

6. Shipping and Delivery

Urban Scartify's Nexorai Cart logistics network delivers to most Indian pin codes. Delivery times are estimates and may vary due to logistics conditions, public holidays, or unforeseen circumstances. We are not responsible for delays caused by third-party delivery partners.

7. Intellectual Property

All content on the Urban Scartify platform — including text, images, logos, graphics, and the Nexorai Cart software — is owned by or licensed to Urban Scartify. You may not copy, reproduce, distribute, or use any content without prior written consent from Urban Scartify.

8. User Conduct

You agree not to:

• Use the Urban Scartify platform for any fraudulent, unlawful, or harmful purpose
• Attempt to gain unauthorised access to any part of the Nexorai Cart system
• Post or transmit any harmful, defamatory, or obscene content
• Engage in data scraping, hacking, or reverse engineering of our platform
• Create false reviews or engage in deceptive practices

9. Marketing Consent

By submitting an enquiry form on Urban Scartify and ticking the marketing consent checkbox, you explicitly agree to receive promotional communications from Urban Scartify (Nexorai Cart) via email, SMS, RCS, and WhatsApp. You may withdraw this consent at any time via the unsubscribe option in any message.

10. Limitation of Liability

To the maximum extent permitted by law, Urban Scartify (Nexorai Cart) shall not be liable for:

• Any indirect, incidental, or consequential damages arising from platform use
• Loss of data, revenue, or profit resulting from platform downtime
• Damages arising from third-party seller conduct or delivery partner delays

Our total liability shall not exceed the amount paid by you for the specific order giving rise to the claim.

11. Governing Law

These Terms are governed by the laws of India. Any dispute arising from your use of Urban Scartify (Nexorai Cart) shall be subject to the exclusive jurisdiction of the courts in India.

12. Changes to Terms

Urban Scartify reserves the right to update these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
